Definition of terms used in the privacy policy

  • « Service » : the Kalipi service and all of its contents.
  • « Publisher » or « We » : Thierry Linsolas, a legal or natural person responsible for the publishing and content of the Service.
  • « User » or « You » : The internet user who visits or uses the Service.

Article 1 - Introduction and role of the Privacy Policy

The present charter aims to inform you of the site’s commitment with regards to the respect of your private life and the protection of your personal information that is collected and processed during your use of the service.

It is important that you read this Privacy Policy so that you are aware of why we use your data and how we do it.

By registering with the service, you agree to provide true information about yourself. Submitting false information is a violation of the General Conditions contained on the application.

Please note that this Privacy Policy may be modified or added to at any time by NPERF, including to comply with any legislative or regulatory developments. The date of its update will be clearly mentioned, if any.

These changes commit you as soon as they are posted online and we invite you to regularly consult this Privacy Policy to be aware of any changes.

Article 2 - Data collected on the site

The Data collected and subsequently processed by the Service are those that you voluntarily transmit to us by completing the various forms present within the Service. To use certain aspects of the Application content, you may be asked to submit your personal data to third-party partners through their own services, specifically in order to make payments. We do not have access to such data, nor to their collection or processing of said data which is governed by these partners' terms and conditions. We ask that you review these terms and conditions before submitting your data.

Your IP address (identification number assigned to your computer on the Internet) is collected automatically. You are informed that the service may implement an automatic tracking process (Cookie), which you can block by changing your internet browser settings as explained in the website’s general terms and conditions.

In general, you may visit the Kalipi Service without voluntarily disclosing any personal information about you. In any case, you have no obligation to transmit this information. However, in case of refusal, you may not be able to benefit from certain information or services that you have requested.

We also collect, use and share aggregated data such as statistical or demographic data for any purpose. Aggregated data may come from your personal information but is not legally protected as such data does not directly reveal your identity. For example, we can aggregate your usage data to calculate the percentage of users who access a specific feature of the Service.

For the purpose of providing better content and services, the Kalipi Service uses the analytics service of Google Analytics. Google Analytics does not follow your browsing habits on third-party services. The information about you to which Google Analytics has access does not contain any personal data about you.

We do not collect so-called "sensitive" data.

The contact information of users who have registered on the application will be stored in compliance with the Data Protection Act of January 6, 1978. According to this, users have the rights to access, remove, modify or correct of the data they provided. The collection of Personal Data of Users by the Publisher does not require a declaration to the French authority for the protection of personal data (the National Commission for Data Processing and Freedoms - CNIL).

The controller is Mr. Thierry Linsolas.

Article 4 - Purpose of the Data Collected

The Data identified as mandatory on the forms of the Service are necessary in order to benefit from the corresponding functionalities of the Service, and more specifically to operations on the contents offered within it.

The Service may collect and process the data of its users:

  • For the purpose of providing you with the information or services to which you have subscribed, in particular to calculate the daily energy needs of the user.
  • For the purpose of collecting information that allows us to improve our Service, our products and features (including the use of cookies).

Article 5 - Recipients and use of collected data

You collected data will be processed for content operation’s needs.

You may receive emails from our Service, including newsletters that you have accepted. You can request to not receive these emails by contacting us at [email protected] or on the unsubscribe link that is included in each email that will be sent to you.

Only Thierry Linsolas is the recipient of your Personal Information. These are never passed on to a third party, notwithstanding the subcontractors that Thierry Linsolas uses. Neither Thierry Linsolas nor its subcontractors sell the personal data of visitors and users of its Service.

Your personal data may be shared with the parties listed below for the purposes set out in this Privacy Policy.

We require that all third parties guarantee the security of your personal data and treat it in accordance with the law. We do not allow our third-party service providers to use your data.

Article 6 - Legal basis for data processing

In accordance with the General Data Protection Regulation (RGPD), Thierry Linsolas only processes personal data in the following situations:

  • When there is a contractual obligation (a contract between Thierry Linsolas and you) ;

Please note that your data may be disclosed in the case of law enforcement, ruling or a decision of a competent regulatory or judicial authority or, if necessary, in order for the Publisher to protect their rights and interests.

We have put in place appropriate security measures to prevent your personal data from being accidentally lost, used, modified, disclosed or accessed without authorization. In addition, access to your personal data is subject to a defined and documented security procedure.

Article 8 - Data retention period

Data are stored by the service's host, whose details are included in the website’s Legal Notice, and are kept strictly for the time necessary to achieve the purposes referred to above. Beyond this period, data will only be kept for statistical purposes and will not be used for any other purpose whatsoever.

Article 9 - Authorized service providers and transfer to a third country of the European Union

Thierry Linsolas informs you that he has recourse to authorized service providers to facilitate the collection and processing of the data that you have communicated to us. These service providers are located in the European Union exclusively.

Thierry Linsolas has previously ensured the implementation by its providers of adequate safeguards and compliance with strict conditions of confidentiality, use and data protection. These service providers are also subject to the General Data Protection Regulations (GDPR).

Article 10 - Computer rights and freedoms

  • The right of information: we have the obligation to inform you of how we use your personal data (as described in this privacy policy).

However, the exercise of this right is possible only in one of the following two situations: when the exercise of this right is based on legitimate grounds or when the exercise of this right is intended to prevent that the data collected are used for commercial prospecting purposes.

You will not have to pay any fees for access to your personal data (or for the exercise of any other right). However, we may charge you a reasonable fee if your request is manifestly unfounded, repetitive or excessive. In this case, we may also refuse to respond to your request.

Thierry Linsolas will have the right, if necessary, to oppose obviously abusive requests by their systematic or repetitive nature, or their number.

We may ask you for specific information to confirm your identity and to ensure your right to access your personal data (or to exercise any other right). This is a security measure to ensure that this personal data are not delivered to a person not authorized to receive them. We may also contact you to obtain more information about your request, to give you a faster answer.

We try to respond to all legitimate requests within one month. This period of one month can be exceeded in case your request is particularly complex or if you have made several of them. In this case, we will notify you and keep you informed.

Article 11 - Complaint to the Data Protection Authority

If you consider that Thierry Linsolas does not comply with its obligations regarding your personal information, you may submit a complaint or request to the competent authority. Article 12 - Cookie policy

When you first use the Kalipi Service, you are warned by a banner that information about your browsing may be stored in alphanumeric files called "cookies". Our cookie policy allows you to better understand the provisions that we implement in terms of navigation on our website. It informs you in particular about all cookies on our website, their purpose, and gives you the procedure to follow to set them.

a) General information about cookies on the site

Thierry Linsolas, as publisher of this Service, may store cookies on the hard drive of your device (computer, tablet, mobile etc.) to ensure a smooth and optimal navigation on our Service.
